LUX Payband. ("us", "we", or "our") operates the https://luxpayband.io website (hereinafter referred to as the "Service").

Definitions

Service is the https://luxpayband.io website operated by Maned Owl Events, LLC dba LUX Payband.

LUX Payband will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. LUX Payband will also retain Usage Data for internal analysis purposes. Terms and Services

Agreement to use our services:
You agree to the following by use of the LUX Payband and its applications an interface (“LUX” or “LUX Payband”), services, mobile applications, software, services, and any other application, websites, services, software and other related services provided by Maned Owl Events, LLC, its subsidiaries, any third party chosen by us (collectively, with the Website, the “Service(s)” and/or any affiliates ("LUX Payband", “Maned Owl Events”, “DeLUX”, “DeLUX Ticket”, “Mane Holdings”, “us”, “we” and “our”) is thereby subject to the terms listed below, encompassing the Privacy Policy of LUX Payband but not limited by the policy, which is thereby added by reference (collectively, the “Terms”).

It is incumbent on the user to review these Terms and any and all of the documents referred to in the Terms and understand without equivocation this creates a legally binding agreement between the entity (“you” or “your”), person or persons and LUX Payband. The users agree by opening, reading or gaining access to this User Agreement or utilizing the Services, or showing accepting of these Terms in any way, the user affirms that: (i) You have the mental capacity to enter into this user agreement, you are at least 18 years of age or older, you are in fact an individual, and consent to be legally bound by the conditions and terms of this User Agreement and all of the Terms; (ii) You are an organization, a business entity or corporation, governmental body, institution or governmental organization or any type of legal entity, acknowledging you have the legal authority, power and right to consent an enter into this User Agreement as a representative behalf of the organization, business entity or corporation, governmental body, institution or governmental organization or any type of legal entity, other legal entity and bind them to these Terms. Any individual, entity, corporation, government or institution not in agreement or acceptance of this User Agreement must not access or use the Services.

Privacy policy
We reserve the right to collect and share any data on our platform if we so choose. All users must review our Privacy Policy on how we collect, use and share your information. All data, information we collect will be used and stored in accordance with our privacy policy. LUX Payband may also change, revise and modify our Privacy Policy from time to time without notice to the user. It is the user’s duty and responsibility to stay abreast of the Privacy Policy.

LUX Payband terms
The LUX Payband platform is access via registration of user information. The user may be required to provide detailed information in the registration process to use the services. Users must provide their name, first and last, a valid email address and create a password for access your account (“Account”). Users by using the service acknowledge and agree and assume sole responsibility for maintaining and keeping all user’s information, private keys and passwords safe. This includes personal information, emails and any information associated with the user’s account. As crypto private keys are the only thing keeping unwanted users out of user’s wallet. Users agree to not share or irresponsibility permit anyone or party access to their login passwords or information and will not hold LUX Payband harmless for any actions taken by individuals unauthorized to access you’re the users Account. In addition, users agree to assume full responsibility to LUX Payband for all activity that happens to and with the users Account and hold LUX Payband harmless for any problems with the users Account on account of unscrupulous behavior for loss of any personal of login date such as loss of private keys, emails and login passwords.

Each user account has requirements for creating, maintaining and closing of an Account:
All Accounts must be registered by individuals, institutions or entities. No “bots” or other automated registration services are allowed. Any account mimicking this pattern will be halted pending user verification.
Users may receive and consent to emails from LUX Payband to the email used during registration relating to the user Account. All users agree and acknowledge to hold LUX Payband harmless for any lose or harm suffered on account of failure to receive any email notification or notice as it relates to this User Agreement and usage of Services if email sent to email provided on registration is not received.

LUX Payband age requirement to open an account is 13 years of age when the wallet is used for tickets. The age requirement to store all Stellar based tokens is 18 years of age. All users reserve the right to cancel accounts at any time. An official email request must be submitted. However, this does not mean data may not be used or stored in an encrypted backup. However, all data is lost to the customer after such time.
Users may cancel their accounts but will remain liable for all transactions that occurred before cancellation.
Users agree and acknowledge LUX Payband reserves the right to terminate users account on account of violation of this agreement and policies, or violation of any Government, Federal or State laws without notice to user.

Severability
If at any time a court of law having proper jurisdiction rules any part of our Terms are unenforceable, only that provision will be removed, and the remainder of our Terms will remain valid an enforceable.
User puts forth and statements
Usage of our services and the LUX Payband software, in particular, you the user puts forth and states that you consent, understand, acknowledge, and assume all risk of the following actions:

LUX Payband is furnished for usage to all user from Maned Owl Events, LLC, a separate business entity with no direct affiliation with the Stellar Development Foundation. LUX Payband is an application, software and services built on the Stellar Network. This is an open platform for developers and does not constitute a partnership whatsoever. LUX Payband is designed to be a wallet for storing digital tokens or tickets and is not an exchange. LUX Payband has not direct knowledge, communication or control of the Stellar Network and unable to control the future plans an action of the network. All users acknowledge and consent to understanding. The Stellar Network is a decentralized network of several trusted organizations running validators. LUX Payband is an interface built on this platform. All users will be communicating directly with the Horizon Stellar API.

LUX Payband and accounts are created on the Stellar network (“Stellar account”). A cryptographic public and secret key are created within the LUX Payband by software also enabling users to store digital tickets within LUX Payband as well as send and receive Stellar lumens (“XLM”) or any supported crypto asset on the Stellar Network. LUX Payband reserves the right to change the “home_domain” and “inflation_destination” of the users Stellar account, unless your Stellar account participates in the paying inflation pool once users create an Account. All users have the sole responsibility for creating and storing a backup of your Stellar account, outside of the LUX Payband as well as a secret key or transaction information that you maintain in your LUX Payband or otherwise with the Services. All users are strongly encouraged to create and maintain a backup of your Stellar account private and public keys outside of the LUX Payband, in case of any unforeseen scenarios. Such as discontinuation of LUX Payband, change of services or updates. As users may lose access to stored crypto assets stored within LUX Payband. LUX Payband is not responsible, and user agree to hold LUX Payband harmless for failure to back up and stored all private and secret keys.

LUX Payband is has no access to your tokens or crypto assets or secret keys or passwords. LUX Payband currently is only designed to store Stellar Lumens and Stellar based tokens. Tickets are Stellar tokens. No other asset is currently designed to be stored in the wallet. All users are instructed to verify any cryptocurrency transaction created in the wallet is confirmed on the cryptocurrency ledger associated with the Stellar Network.
The user agrees to hold LUX Payband harmless as we have no control over Stellar Network transactions you submit within our wallet will be posted to the Stellar Network. The nature of the blockchain is built around nodes and transmission which can have delays. Users must understand blockchain transactions cannot be reversed. Once the transaction has been sent within our wallet there is nothing that can be done to reverse the transaction. Once tickets are scanned and transferred nothing can be done. So, users acknowledge and agree to hold LUX Payband harmless. All transaction requests on the Stellar Network are irreversible.

LUX Payband does not charge a fee to transmit digital tickets or transfer Stellar tokens. However, we reserved the right in the future to do so. The Stellar Network charges fees to transfer lumens and tokens. We will attempt to calculate the fees however it is the user’s sole duty to know and calculate all fees. Thus, all users agree to hold LUX Payband harmless for any and all fees incurred using our services. Users acknowledge and consent to all inherent risk and agree to: (i) not share and store all secret keys, tokens and crypto assets, (ii) of using, exchanging, reviewing, reading about all assets transacted, (iii) staying in legal compliance by transacting in only legal assets and parties, (iv) verifying and creating trust lines with only trusted parties and assets, and (v) using LUX Payband to make transactions and ticket operations.

Modifying of the terms & Updates
We LUX Payband reserve the right to modify, change or revise this User Agreement in any way, for any reason at our sole discretion by simply updating the posting on our website at DeLUXwallet.com. All revisions, modifications, changes and updates will be effective immediately once posted on our website at DeLUXwallet.com, or upon using the Services.

Continued usage of any and all applications, services or software will serve as the user’s absolute consent, acknowledgement, understanding and acceptance of the updated If you continue to use the Services after such change or modification, you will be deemed to have read, understood, and unconditionally agree to such changes. Any user who does not agree, understands, consents or accepts the changes must stop using all software, applications and services immediately and purge your account. All users must read this agreement in its entirety and periodically review the Terms and User Agreement to stay abreast of any and all changes.

Financial Risk
Crypto assets are volatile assets and pose considerable risk. Use by virtue of opening and using our software or services or User Agreement, acknowledge and consent there are considerable risks associated with crypto assets and technology including, but not limited to, the risk of failure of hardware, internet and software connections, unreliable project with considerable risk of price collapse and volatility for tokens issued on the Stellar Network. Also, the users assume the risk of using malicious software, as well as third parties gaining access to public and private keys and passwords gaining unpermitted access into LUX Payband and your cryptoassests. You acknowledge and consent and assume full responsibility for technology, software, errors, disruptions, distortions, delays you may experience using the LUX Payband software and related products.
